Information in connection with the processing of personal data
IN CONNECTION WITH THE OPERATION OF the website and e-shop of BARACUDA s.r.o.
pursuant to Article 13 GDPR (hereinafter referred to as “GDPR”)
Controller – BARACUDA, s.r.o., registered office: Muškátová 12 Bratislava 821 01, Slovak Republic, ID No.: 35 818 921, legal form: limited liability company, registered in the Commercial Register of the Municipal Court of Bratislava III, Section: Sro, Insert No.: 24795/B (hereinafter referred to as the “Operator”), hereby provides the data subjects, the visitors of the website BARACUDA s.r.o., with. r.o. (hereinafter referred to as “Lilawadi”) and users of the e-shop (hereinafter referred to as “Data Subject”), information on the processing of their personal data.
What personal data is processed?
The Controller may process (directly or through third party processors) the following information about the Data Subject:
- in the case of a visit to the Lilawadi Site, cookies necessary for the operation of the Lilawadi Site (further information on the use of cookies is provided later in this document);
- in the case of booking and related order administration, the name, surname, address, telephone number, e-mail, personal data, where applicable, provided in the order note by the Data Subject and payment details,
- in the case of marketing communications, the name, surname, address, telephone number and e-mail of the Data Subject.
What is the purpose of the processing?
The purpose of processing the Data Subject’s personal data is:
- Ensuring the proper technical functioning and improvement of the Lilawadi technical site, the user experience when using the Lilawadi site, and the provision of personalized advertising through third-party services;
- Ensuring the provision of additional functionality to Lilawadi and enhancing the user experience when using the core functionalities of Lilawadi;
- the implementation of booking contracts based on the inputs of the Concerned Party and the exercise of related claims;
- troubleshooting glitches and problems encountered by a Concerned Person while using the Lilawadi Services or the Lilawadi Site;
- marketing communications (other than those referred to in (a) above), in particular active information (via email, SMS, web services, telephone, social networks and other communication channels) about our activities or services and about the activities and services of third parties or for the processing of certain cookies, where consent is required. Information about the processing of cookies is a separate section of this information.
What is the legal basis for the processing?
The legal basis for the processing of your personal data collected is:
- the legitimate interest of the Controller in accordance with Article 6(1)(f) of the GDPR;
- performance of the contract in accordance with Article 6(1)(b) GDPR;
- performance of the contract in accordance with Article 6(1)(b) GDPR;
- performance of the contract in accordance with Article 6(1)(b) GDPR;
- consent pursuant to Article 6(1)(a) GDPR.
Does the processing of personal data involve automated decision-making or profiling?
There is no automated profiling or automated individual decision-making in the processing of the Data Subject’s personal data that would have any legal or other effects on the Data Subject that would have a similarly significant impact on the Data Subject.
To whom will the personal data be disclosed?
The personal information of the Data Subject shall be strictly protected by the Controller. The Controller shall not use the Data Subject’s personal data for any purpose other than the purpose stated above. In securing the achievement of this purpose, the Data Controller may only disclose the Data Subject’s personal data to a verified supplier of the technologies used by the Data Controller, and only to the extent necessary to fulfil its contractual obligations towards the Data Controller and subject to ensuring the protection of personal data.
How does the Data Controller handle the Data Subject’s personal data?
As the protection and care of the Data Subject’s personal data is important to the Controller, the Controller has adopted and continuously ensures appropriate security measures to protect the Data Subject’s personal data from destruction, loss, unauthorised disclosure or other unauthorised operation. This includes, in particular, the use of encryption technologies, logging, the adoption of pseudonymisation or anonymisation of data (insofar as their implementation is possible), as well as ensuring the continued confidentiality, integrity and resilience of processing systems and the regular testing, assessment and evaluation of the effectiveness of technical and organisational measures to ensure the security of the Data Subject’s data.
The Data Subject’s personal data shall in no case be transferred by the Data Controller, directly or through third parties, outside the European Union and the European Economic Area.
What is the duration of the processing of personal data?
The personal data of the data subject are processed by the Controller:
- for the period strictly necessary to achieve the purpose of the processing of the personal data; or
- for the duration of the contract and any claims or legal obligations in connection therewith.
The Data Subject’s personal data may be processed by the Data Controller for longer than specified above only if this is necessary for the fulfilment of the Data Controller’s obligations arising from legal regulations, or if it results from decisions of public authorities or is necessary for the exercise of the Data Controller’s rights.
Cookies
We would also like to inform you about the processing of your personal data relating to cookies.
11.1 What are cookies?
Cookies are small text files that are stored on your device. You can refuse to accept (or deactivate) cookies at any time via the settings in your web browser. If you refuse to accept cookies, some parts of our Lilawadi website may not be accessible. If you do not adjust the settings in your web browser, our system will store cookies when you connect to our Lilawadi site through your web browser.
11.2 How do we use cookies?
Our Lilawadi website uses cookies to store:
- Information about your behaviour and movements on our Lilawadi website for the purpose of analyses leading to its improvement;
- Whether you have consented (or not) to our use of cookies on the Lilawadi site;
- The information you have entered into contact forms so that you do not have to retype them in the future;
- Also, some of the videos that are part of our site use cookies to anonymously collect statistics about how you got there and which video clips you watched.
Allowing the use of cookies is not strictly necessary for the proper functioning of the Lilawadi site, but it will provide you with a better user experience when working with it. You can delete all cookies stored on your device and you can set most browsers to prevent them from being stored. However, if you do this, you may have to manually adjust some settings each time you visit the Lilawadi site and some services and features may not work.

What are the rights of the Data Subject in the processing of personal data?
The following are the rights that the Data Subject has in relation to his or her personal data. If the Data Subject wishes to exercise any right or obtain more information about it, he or she may contact the Data Controller using the contact details below. The exact conditions for exercising each right are set out in Chapter III of the GDPR, and not all rights may be applicable in a particular situation.
In the case of the exercise of any right, the Controller may first request further information in order to confirm the identity of the person exercising the right.
Right of access to data
The data subject has the right to access information about his or her personal data processed by the Data Controller about him or her. If the Data Subject has any questions about the processing, he or she may contact the Data Controller using the contact details provided below.
Right to rectification
The Data Subject has the right to request that the Data Controller rectify, without undue delay, the data which it has recorded about him or her incorrectly. The data subject also has the right to have incomplete personal data completed, including by providing a supplementary declaration.
Right to erasure
The data subject has the right to request the Data Controller to permanently delete his or her personal data. The Data Subject may exercise this right, for example, if he or she considers that the personal data are no longer necessary for the purpose for which they were collected or if the consent to the processing has been withdrawn.
Right to restriction of processing operations
The Data Subject has the right to request that the Controller restrict processing operations with personal data, for example, if the Controller no longer needs the personal data but the Data Subject needs it for legal purposes.
Right to portability of personal data
The Data Subject has the right to obtain his or her personal data in a structured, commonly used and machine-readable format and to request that the Data Controller transfer the data to another Data Controller, if technically feasible.
Right to lodge a complaint with the supervisory authority
If the Data Subject intends to lodge a complaint regarding the processing of his or her personal data by the Data Controller, the Data Subject may at any time contact the Data Controller or directly lodge a formal complaint with the local supervisory authority.
